What are landlord’s legal obligations ?
These include :-
- Structure of the property, that is doors, walls, roof
- The property must be safe and regularly maintained
- Driveways, paths and any and gateways
- Communal areas such as hallways and stairs
- If the tenant has given the landlord a notice of disrepair, he must fix the problem even though the tenant may have not paid rent. This can be taken into consideration when eviction procedure is started.
- If the landlord fails to follow health and safety guidelines, he may face criminal prosecution.
- It is landlord’s responsibility to ensure that any electrical appliances such as kettles, cookers and heaters in the property are safe. If these are not included in the property, and the tenant uses his own then it is tenant’s responsibility.
- Gas fittings and appliances are also landlord’s responsibility. They must be safe for use. If there is any suspicion that they are not, then safety checks must be arranged and any essential work carried out.
- Arrangement for pest control is landlord’s responsibility if the problem is not caused by the tenant. If landlord refuses to do it, the environmental health might be able to do it for free.
